1011 : Promulgation of Rules
Safety and health rules can be created, amended, or revoked
Bureau drafts proposed rules based on received information
Tripartism: Consultation with experts, agencies, and organizations
Bureau considers suggestions and finalizes the proposal
Director submits proposal to Secretary for approval within 30 days
If rejected, Bureau revises and resubmits the proposal
Approved rules are published and take effect after 15 days
1012.01 : Work Conditions or
Not Covered by Standards
Covers work conditions or practices not addressed in existing rules
Specific rules apply to similar work situations for consistency
Ensures all hazardous conditions are regulated
Expands safety coverage beyond predefined standards
Employers must comply with applicable regulations in all cases
1012.02 : Abatement of Imminent Danger
• Imminent danger: A condition likely to cause death or serious harm
• Enforcement officer identifies and informs employer & workers
• Recommends stoppage of operations or corrective measures
• Regional Director evaluates the situation and issues an Order
• Employer must take immediate action to protect workers
Other Safety Rules : Issuance of a Stoppage Order
• Order specifies necessary steps to remove or correct the danger
• Prohibits workers from entering hazardous areas
• Exceptions: Only essential personnel allowed for safety corrections
• Stoppage of operations permitted only if done safely and in order
• Ensures safety procedures are properly followed before resumption
Other Safety Rules : Review &
Enforcement of Stoppage Order
• Regional Director submits Order & documentation to the
Secretary
• Secretary reviews the case within 5 working days
• Decision: Lift or sustain the Stoppage Order
• Order remains in effect until the danger is fully eliminated
• Strict monitoring ensures compliance before resuming operations
1012.03 : Suspension of Rules
The Secretary may temporarily suspend a rule if an employer faces:
- Lack of personnel, materials, or equipment
- Construction delays
- Participation in approved safety experiments
Employers must justify the request, ensure worker safety, set a compliance
plan, and inform workers.
The Regional Director reviews the application before the Secretary’s
decision.
An interim order may be issued while awaiting approval.
The suspension lasts up to one year, renewable once, but can be revoked or
adjusted.
1012.04 : Variation Order
If compliance is difficult, the Secretary may approve a variation upon
written request, ensuring worker safety.
An application for a variation shall contain:
a. Specify the rule or provision for which a variation is sought.
b. Provide an expert attestation with reasons for non-compliance.
c. Detail measures taken or planned to protect workers.
d. Certify that workers have been informed and given a copy.
A variation order sets conditions for approval, applies only to the specified
employer and operations, and remains in effect until revoked by the Secretary.
1013: Hazardous Workplaces
For purposes of this Standards, the following are considered “hazardous
workplaces:”
a. Work exposing workers to hazardous elements like radiation, chemicals,
or fire.
b. Jobs in high-risk industries such as construction, mining, or firefighting.
c. Handling or manufacturing explosives and pyrotechnics.
d. Use or exposure to power-driven or explosive tools.
e. Exposure to biological agents like bacteria, viruses, or parasites.
