Edit – should allow for LCIP ( Large Complex Infrastructure Projects ) experience to be used for Entity and Team experience or explicitly state that this is not a requirement for those with LCIP projects. This LCIP addition should then also be reflected in text of Appendix B or explicitly state that this is not a requirement for those with LCIP projects.

LCIP experience to be used or explicitly state that this is not a requirement for those with LCIP projects.

Using external experience requires a ‘sole-source’ arrangement with external engineering firm. This ‘buying’ of

Team experience may not be easy for Applicants that are municipal governments. The public is critical of ‘solesource’ arrangements. City of Hamilton would prefer if Team experience could draw on LCIP projects or if Team experience requirement were to be relaxed, so that City of Hamilton can qualify.

App. A – Glossary – LCIP

Please Delete – it is not reasonable to compare delay on a $100 million LCIP to a $10 million LRP project. This requirement discriminates against public sector project (eg. Wastewater) that have political or community issues.

Please add – LCIP experience

Clarify “most recently completed” – it takes up to 60 days to publish financial statements for the preceding

Quarter. If IESO chooses a bid submission date that is within this time window, then the statements for the ‘most recently completed’ Quarter will simply not be available. Alternatively, remove the requirement for Quarterly financial statements entirely and replace with an officer declaration that there has been ‘no material change’ since the issue of the last audited annual financial statements.

Delete “audited” – it is not industry practice to ‘audit’ Quarterly financial statements (Annual only). Question, does

IESO publish ‘audited’ Quarterly statements?

Commitment Letter (4.)

Please Edit - LCIP project sizes of $10 million, $100 million or $200 million are too high (this equates 10 times the size of the proposed project). It is suggested that the size LCIP be reduced to 5 times of the proposed project, i.e.,

$5 million, $50 million, $100 million is more reasonable. It is reasonable to show that both the entity and team members have the necessary experience in planning, designing, constructing, and financing projects at this size.

Please clarify “objective condition” – specifically, clarify that ‘subject to approval of LRP Contract by City Council’ is considered an ‘objective condition’ by IESO. The City of Hamilton cannot issue a commitment letter without a council approval clause.
