6. History of title in respect of said lands.
i) History of Title of "1 - A" land
a) The land bearing Survey No. 101, Bhugaoni, Taluka Mulshi,
District Pune originally belonged to Rajaram Krishnaji Ingawale,

Shankar Dharmaji Ingawale, Sadhu Dharmaji Ingawale, Dashrath
Dhondiba Ingawale and Dattu Dhondiba Ingawale.
b) Rajaram Krishnaji Ingawale' died in the year 1948 leaving behind
hiin widow Tarabai and two sons namely Vasant and Shashikant.
The names of these legal heirs were duly ,entered in the' revenue
records by mutation entry No. 979 dated 20/12/1951.
c) Mr. Vasant Rajaram Ingawale died on 26/9/1978 leaving behind'
him his widow Sindhu, two sons namely Sharad and Vilas and a
,daughter namely Surekha. The names of thebe legal heirs were duly
recbrdedby mutation entry No. 2028 dated Q4/10/1980.
d)Mr; Sharad Vasant Ingawale died at Jamnagar (Gujrat) on
4/2/1987. As he had no first class legal hei~sto succeed, the names
of the other legal heirs of Mr. Vasant R~jaram Ingawale which
were entered on the,reyenuerecord by Mudltion Entry No. 2028 as
the legal heirs of late Mr. Sharad Ingawale also and Mutation Entry
No. 3146 was passed to that effect on 4/1/1988.
e) Mr. Sadhu Dharmaji Ingawale diedin the y~ar 1970 leaving behind
him his two wives (widows) namely Cha,bdrabai and Gangubai.
The names of Chaildrabai and Gangubai were duly t:.ecordedin the
revenue', records.by Mutation Entry No. 1754. Subsequently
Gangubai Sadhu Ingavale also died in the year 1975 and as she was
not having any issues, Chandrabai.became entitled to her share in
the said Survey NO.l01 as per Mutation Entry No. 1955.
t) Subsequently Smt. Chandrabai Sadhu Ingawale died on 7/8/1985.
She had no legal heirs of Class - I degree. Khandu Dharma
Ingawale washer real nephew who predeceased her in the year
1977 and as such Chandrabai' s share in the property merged into
the share of legal heirs of Late Khandu Dharma Ingawale.
Accordingly mutation No. 3076 dated 24/3/1986 was carried out
and the following names were entered on the revenue record.

died in the year 1978 leaving

1979 leaving behind her grand sons i.e. Dagadu Khandu
.Inga~ale, Arun Khandu Ingawale and Manik ~andu
Ingawale. And their names were entered on the revenue record
by Mutation Entry No. 2061 dated 28/5/1981.

k)Mr.DattuDhondiba
Ingawaledied at Mumbai leaving behind
his only son Narendra alias NathuDattu Ingawale as legal
heir. The name of Mr. Narendra alias Nathu Dattu Ingawale is
duly recorded in the revenue records vide Mutation Entry No.
2096 dated 3/12/1981.
1) Mr. Narendra alias NathuDattu Ingawale died at Mumbai on
11/4/1989 leaving behind him his widow Sheela Narendra
Ingawale, Son Mr. Nandan Natendra Ingawale and married
daughter Mrs. Sadhana Nandkumar Pathare. The names of

b) Bhimab~i Rawaji Ingawale died on 19/9/1964. She had no
legal heirs of Class I degree. Hence her nephews i.e. Abuji
Namdeo Ingawale and Pandharinath Bhivaji Ingawale,
TukaramBhivaji Ingawale carried out the Mutation and by
Mutation Entry No. 1660 dated 23/9/1964 the names of Abuji
Namdeo Ingawale, Pandharinath Bhivaji. Ingawale and
Tukaram BhivajiTngawale were recorded in revenue records.
c) Abuji Namdeo Ingawaledied on 6/11/1973 leaving behind
him two sons namely Ramchandra. Aburao Ingawale,
Genubhai Aburao. Ingawale and two marrid daughters namely
Shantabai Narayan Kawade and Parubai Namdeo.Kumre. The

others, agreed to sell" convey and transfer the said lands, to
Matrix Developers Private Limited, which has been duly
registered in the office of Sub-Registrar, Mulshi (Paud) at Sr.
No. 2616/2008 dated 2/4/2008.
c) Mr. Sanjay Ramchandra Kulkarni and 11 others, also
executed an Irrevocable Get:leral Power of Attorney dated
20/3/2008 in respect of the said lands, in favour of Matrix
Developers Private Limited, which has been duly registered

d} Thereafter Matrix Developers Pvt.' Ltd. has paid the entire
agreed consideration to Mr.' Sanjay Ramchandra Kulkarni
and 11 others in respect of the said lands and by executing a
Possession Receipt dated 5/4/2008, they!have handed over
peaceful and vacant possession of the said lands to Matrix
Developers Private Limited, which Poss~ssion Receipt has
been duly registered in the office of Suq-Registrar, Mulshi
(Paud)at Sr. No. 2767/2008 dated 7/4/2008.
e) In pursuance of the said Agreement lfor Sale (without
possession) dated 20/3/2008, by a Sale D~ed dated 5/4/2008,
Mr. Sanjay Ramchandra Kulkarni and 11 others have sold,
conveyed and transferred the said jlands, to Matrix
Developers Private Limited, which Sale IDeedhas been duly
registered in the office of Sub-Registrar, Mulshi (Paud) at Sr.
No. 2766/2008 dated 7/4/2008.

The said lands are situated at village Bhugaon, Taluka Mulshi, District
Pune within the jurisdiction of Zilla Parishad Pune, Panchayat
Samitee, Taluka Mulshi, Dis~rict Pune. The Regional Plan for Pune
District has been sanctioned w.e.f. 10/02/1998. and the village
Bhugaon is covered under the said Regional Plan. On perusal of
various Zone Certificates issued by Assistant Director, Town
Planning, Pune Division Pune issued in the year 2006-2007 it is
observed that; the zoning of the said lands is Agricultural and no
development as per the aforesaid sanctioned Regional Plan.

However, all the. lands out of the said lands haye been regularised
under the provisions of Maharashtra Gunthewari (Regularization,
Upgni~ation .and Control) Act, 2001 (hereinafter referred to as the
"GunthewariAct") by.the Collector, Revenue Branch, Pune by the
afor~sdid Preliminary order dated 16/02/2006 and fidal .order dated
28/06/2006. The demarcation of the said lands is also iearried out by
TILR, MulshiPune as per the provisionso'f the Gunthe!wari Act and a
layout in respect of the said lands has also been sanbtioned by the
Colleetor,Revenue
Branch, Pune vide aforesaid Order dated
09/1 0/~006. Consequently, as per the provisions of section 5 of the
Gunthewari Act, the" said lands shall be deemed to have been
exempted U/S 20 of the Urban Land (Ceiling and R~gulation) Act,
1976 ahd converted to non-agricultural Use for all tne purposes of
Maharashtra Land 'Revenue Code, 1966 subje9t to payment of nonagricultural. asseSsment etc. As. per the order dated 28/6/2006 passed

PMAlNAISR/I:31/2005, it is seen that all the-required amounts of
development charges,N.A. assessment, Zilla Parishad taxes, Grall,l

8. I~itigations :
From the enquiry and. investigation of title, I did not come across any
pending litigation in respect of the said lands.

9. Encumbrances
and charges:
From the perusal of various documents and the Search carried out by
us in respect of the said lands, I did not come across any encumbrance
or charge upon the said lands.
10. Custody of title deeds and important
documents:
All the available original title deeds and /.or certified copies thereof in
respect of the said lands are handed over by S. R. Kulkarni & 11
others to Matrix Developers Pvt..Ltd. and now, all such documents are
in the custody of Matrix Developers Pvt. Ltd.

11. Public notice:
..,For investigation of title, I had issued public notices in daily newspaper "Sakal" on 05/12/2007 in respect of the said lands, for inviting
; objections from public at large if anybody having any right, title and
interest or claim therein. However, till date Ihave not received any
objection in response to the .said public notices from any person,
claiming any right, title and interest of whatsoever nature in the said
lands.

;.In view of the above, I am of the opinion tHat the title of Matrix
Developers Pvt. Ltd. as the owners of the said lands, is clean, clear
