MINUTES WEST VIRGINIA BOARD OF EDUCATION Board Conference Room Capitol Building 6, Room 353 1900 Kanawha Boulevard, East Charleston, West Virginia February 8, 2012 I. Call to Order Following the welcome, introductions and Pledge of Allegiance, President L. Wade Linger Jr. called the meeting of the West Virginia Board of Education (WVBE) to order at 12:34 p.m. on February 8, 2012, in the Board Conference Room, Capitol Building 6, Room 353, 1900 Kanawha Boulevard, East, Charleston, West Virginia. The following members were present: President Linger, Vice President Gayle C. Manchin, Secretary Robert W. Dunlevy, Michael I. Green, Priscilla M. Haden, and Lowell E. Johnson, and ex officios Jorea M. Marple, State Superintendent of Schools, Paul L. Hill, Interim Chancellor, West Virginia Higher Education Policy Commission, and James L. Skidmore, Chancellor, West Virginia Council for Community and Technical College Education. Student representative in attendance was Ronald “Trey” Lockhart of Iaeger, West Virginia, who attends Riverview High School (McDowell County). Members absent were Lloyd G. Jackson II, Jenny N. Phillips and William M. White. II. Delegations Mr. Randall Patterson and Ms. Carolyn Arritt, citizens of Fayette County, and Ms. Cami Walker, secretary at Danese Elementary School, addressed the Board in opposition to school closures in Fayette County. III. Recognitions Ms. Liza Cordeiro, Executive Director, WVDE Office of Communications, introduced Mr. Robert Crawford, Assistant Director, WVDE Office of Title II, III, and System Support, who presented a short video featuring world languages in support of Discover World Language Month. Mr. Crawford introduced Ms. Sandra DeVault, Director of Instructional Services, Monongalia County Schools, who provided a short overview of language initiatives offered in Monongalia County Schools; three students from Monongalia County provided information regarding their world language (Chinese) experience. Mr. Mark Moore, Coordinator, WVDE Office of Instructional Technology, introduced Ms. Melissa H. Salvatore, teacher, Paw Paw High School (Morgan County), and Ms. Angel Canon and Ms. Rhonda Dean, teachers, Fairview Middle School (Marion County), winners of a Thinkfinity 21st Century contest. IV. Approval of Agenda President Linger called for a motion to approve the agenda. Mr. Dunlevy moved, and Dr. Johnson seconded, that the agenda be approved. Upon the call for the question the motion was unanimously carried. -2V. Broadband Technology and Opportunities Program (BTOP) Update Mr. Jimmy J. Gianato, Director, West Virginia Homeland Security and Emergency Management, and Mr. Kyle Shaffer (distributed information), Chief Technology Officer, West Virginia Office of Technology, provided an update regarding BTOP. (Copy appended to Official Minutes, Attachment T.) VI. Break President Linger called for a break at 2:03 p.m. VII. Call to Order President Linger called the meeting back to order at 2:15 p.m. VIII. Director’s Information Dr. Gus Penix, Director of the Office of Education Performance Audits, provided brief remarks regarding the amendment process for Policy 2320, A Process for Improving Education: Performance Based Accreditation System, and asked if any WVBE members wished to serve on the review committee. Ms. Haden and Dr. Johnson volunteered to serve on the Policy 2320 review committee. IX. Follow-up Individual School Education Performance Audit Report for Musselman High School, Berkeley County Dr. Penix reported that an announced on-site review was conducted at Musselman High School, Berkeley County October 14, 2010. A Team returned to the above school October 31, 2011. The purpose of the return visit was to verify correction of the findings identified during the original Individual School Education Performance Audit and to recommend a final school accreditation status. Upon the recommendation of Dr. Penix, Ms. Haden moved that Musselman High School, Berkeley County, be issued Temporary Accreditation status with a September 1, 2012, Date Certain to correct the remaining finding. Mrs. Manchin seconded the motion and upon the call for the question the motion was unanimously carried. (Copy appended to Official Minutes, Attachment A.) X. Initial Individual School Education Performance Audit Reports and Revised Five-Year Strategic Plans for Opequon Elementary School, Tuscarora Elementary School, and Winchester Avenue Elementary School, Berkeley County Dr. Penix reported that announced on-site reviews (five days in advance) were conducted at Opequon Elementary School, Tuscarora Elementary School, and Winchester Avenue Elementary School, Berkeley County November 2-3, 2011. The reports were presented to the superintendent, the principals, and the WVDE. The System of School Support immediately initiated assistance to the schools and county in revising the strategic plans and correcting deficiencies reported by the Education Performance Audit. This item includes the Education -3Performance Audit Reports and corresponding corrective actions contained in the revised strategic plans. Upon the recommendation of Dr. Penix, Dr. Johnson moved that Opequon Elementary School, Tuscarora Elementary School, Winchester Avenue Elementary School and the Berkeley County school system, correct the findings noted in the reports by the next accreditation cycle. Mr. Dunlevy seconded the motion and upon the call for the question the motion was unanimously carried. (Copy appended to Official Minutes, Attachment B.) XI. Lowery Elementary School, Jefferson County Dr. Penix reported that an announced on-site review (five days in advance) was conducted at T.A. Lowery Elementary School, Jefferson County November 1, 2011. The report was presented to the superintendent, the principal, and the WVDE. The System of School Support immediately initiated assistance to the school and county in revising the strategic plan and correcting deficiencies reported by the Education Performance Audit. This item includes the Education Performance Audit Report and corresponding corrective actions contained in the revised strategic plan. Upon the recommendation of Dr. Penix, Mrs. Manchin moved that T.A. Lowery Elementary School and the Jefferson County school system correct the findings in the report by the next accreditation cycle. Progress Education Performance Audit Report for the Mason County School District and Ashton Elementary School, Beale Elementary School, Leon Elementary School, New Haven Elementary School, Roosevelt Elementary School, Point Pleasant Intermediate School, Hannan High School, Point Pleasant Junior/Senior High School, Wahama High School, and the Mason County Career Center Dr. Penix introduced Dr. Donna Davis, Deputy Director, Office of Education Performance Audits, who reported that an announced on-site review was conducted of the Mason County School District and Ashton Elementary School, Beale Elementary School, Leon Elementary School, New Haven Elementary School, Roosevelt Elementary School, Point Pleasant Intermediate School, Hannan High School, Point Pleasant Junior/Senior High School, Wahama High School, and the Mason County Career Center October 25-28, 2010. A progress on-site review of the Mason County School District and the aforementioned schools was conducted December 5-8, 2011. The OEPA conducted the review to determine the county’s and schools’ progress in correcting the findings identified during the original County Education Performance Audit. Discussion ensued and Ms. Suzanne Dickens, Superintendent of Mason County Schools, addressed questions from the Board regarding the audit report. Ms. Haden moved that the Mason County Progress Report be accepted, with the exception of impact statement #2. The OEPA recommends that the West Virginia Board of Education release Mason County from further scrutiny by the OEPA and continue the course -4established through the Action Steps document for improvement. Capacity Building for Low Performing Schools, Intervention Counties and West Virginia Schools for the Deaf and the Blind Restructuring of Outreach Services Ms. Michele Blatt, Executive Director, WVDE Office of School Improvement, Dr. Jack McClanahan, and Mr. Ted Mattern, System Support Liaisons, Office of the State Superintendent, provided information regarding capacity building for the intervention counties and a number of low performing schools. Mr. Gary L. Price, Superintendent of Marion County Schools, addressed the Board regarding improvement efforts provided to Marion County. Dr. K. Lynn Boyer, Superintendent, West Virginia Schools for the Deaf and the Blind, provided information regarding the restructuring of outreach services. Continued the Full Accreditation status of Gilmer Elementary School, Jackson County (Attachment F) Continued the Full Accreditation status of Watson Elementary School and the Distinction Accreditation status of West Fairmont Middle School, Marion County (Attachment G) Meeting minutes of January 11, 2012 (Attachment H) One first-time request for a waiver of WVBE policy (Attachment I) Employment of Substitute Teachers in Areas of Critical Need policies for Berkeley, Brooke, Cabell, Greenbrier, Lewis, Mineral, Morgan, Pendleton, Putnam and Wyoming County Schools (Attachment J) Notification, per Senate Bill 227, W. Va. Code §18A-4-7a, Transfer of Teachers After Five Days Prior to Starting Instruction, from Fayette County Schools (Attachment K). Point of Personal Privilege Mrs. Manchin asked if information could be obtained in response to issues offered by the delegations that appeared earlier in the meeting. It was the consensus of the Board that a letter be sent to delegations acknowledging their appearance, that issues identified by the delegations be investigated, and that any findings resulting from the investigation be provided to the Board and to the delegations. -5XVI. Reapproval of Initial Teacher Preparation Licensure Programs Aligned to the West Virginia Professional Teaching Standards (WVPTS) and International Society for Technology (ISTE) in Education Standards Ms. Lori Wiggins, Executive Director, WVDE Office of Professional Preparation, presented the reapproval of initial teacher preparation licensure programs aligned to the West Virginia Professional Teaching Standards (WVPTS) and International Society for Technology (ISTE) in Education Standards for the Board’s consideration. The twenty institutions of higher education with state-approved teacher preparation programs have completed a self-study and have realigned initial teacher preparation programs to the WVPTS and ISTE standards, as specified in Policy 5100. Peer review teams have recommended to the Educator Preparation Program Review Board (EPPRB) that the programs be recommended for reapproval based upon verification that the professional education course objectives reflect alignment to the WVPTS and ISTE and that the institutions have an assessment plan, aligned to the WVPTS, for collecting data around teacher candidate performance. The EPPRB has approved the initial teacher preparation programs based upon the findings of the review team Recommendation Reports for Fairmont State University, Shepherd University, University of Charleston, and West Virginia State University. Dr. Van Dempsey, Fairmont State University, Dr. Jo Blackwood, University of Charleston, and Dr. Sandra Orr, West Virginia State University, addressed the Board regarding the alignment process. Ms. Haden moved that the realigned initial teacher preparation programs of Fairmont State University, Shepherd University, University of Charleston, and West Virginia State University be approved. Dr. Johnson seconded the motion and upon the call for the question the motion was unanimously carried. (Copy appended to Official Minutes, Attachment L.) XVII. West Virginia Annual Application Under Part B of the Individuals with Disabilities Education Act (IDEA) as Amended in 2004 for Federal Fiscal Year 2012 Mr. Robert E. Hull, Associate State Superintendent, Division of Curriculum and Instructional Services, presented West Virginia’s Annual Application Under Part B of the Individuals with Disabilities Education Act (IDEA) as Amended in 2004 for Federal Fiscal Year 2012 for the Board’s consideration. West Virginia annually submits to the U.S. Department of Education, Office of Special Programs its plan to allocate funding under Part B of the Individuals with Disabilities Education Act of 2004 (IDEA), including assurances regarding the state's implementation of IDEA. To receive IDEA funding, WVDE must meet specific public participation requirements, including an opportunity for the general public to comment on the application. The proposed WV Part-B Application is submitted to request approval for posting the plan for the required sixty-day (60) review and public comment period. Mr. Dunlevy moved that posting of the West Virginia Annual Application Under Part B, IDEA, FFY 2012 on the WVDE’s website to accept public comments from February 10, 2012, through April 9, 2012 be approved. Dr. Johnson seconded the motion and upon the call for the question the motion was unanimously carried. (Copy appended to Official Minutes, Attachment M.) -6XVIII. Policy 2445.41, Textbook Adoption: Notice, Request, and Instructions to Publishers Mr. Hull presented Policy 2445.41 for the Board’s consideration. Policy 2445.41 has been revised to incorporate Policy 2445.4 Modifications in Textbook Adoption Regulations, Policy 2445.43 Selection of Textbooks and Other Instructional Materials: Inter-ethnic in Content, Concept and Illustration and Policy 2445.412 Textbook Adoption Appeal Process for Publishers, thus eliminating the need for four separate policies - Policies 2445.4, 2445.43 and 2445.412 will be repealed. This process has also provided an opportunity to align the language in Policy 2445.41 to WV Code §18-2A-1, -2, -3, -4, -5, -6, -7 and -8, which was revised by Senate Bill No. 631 passed March 8, 2010 and effective July 1, 2010. The policy was placed on comment for a period of 30 days, during which time it received no comments. Ms. Alma Simpson, Coordinator, WVDE Office of Instruction, addressed questions regarding electronic resources. Dr. Johnson moved that Policy 2445.41 be approved, with the requested four corrections (found on pages 9 and 10 - changing the word “generic” to “general”) and that Policies 2445.4, 2445.43, and 2445.412 be repealed, effective upon the effective date of Policy 2445.41. Ms. Haden seconded the motion and upon the call for the question the motion was unanimously carried. (Copy appended to Official Minutes, Attachment Mc.) XIX. Policy 1471, Education in West Virginia’s Correctional Institutions: Mission and Goals and Policy 2800, Regulations for the Education of Juveniles Placed in Secure Predispositional Juvenile Centers Dr. Kathy D’Antoni, Assistant State Superintendent, Division of Technical, Adult and Institutional Education, and Dr. Fran Warsing, Superintendent, WVDE Office of Institutional Education Programs, presented Policy 1471 for the Board’s consideration. Revisions to Policy 1471 are being recommended to change the titles of the agencies responsible for working with the WVDE to provide education programs and services for incarcerated juvenile and adults in facilities; updating vocational programs to CTE; and to clarify personnel salaries and benefits. Dr. Warsing presented Policy 2800 for the Board’s consideration. Revisions to Policy 2800 are being recommended due to agency changes. Dr. Johnson moved that Policy 1471 and Policy 2800 be placed on public comment for 30 days. Mrs. Manchin seconded the motion and upon the call for the question the motion was unanimously carried. Superintendent Marple, Mr. Joe Panetta, Assistant State Superintendent, Division of Student Support Services, Mr. Hull, Mr. Charles Heinlein (distributed information), Deputy State Superintendent, Dr. D’Antoni, Ms. Wiggins, Ms. Blatt, and Ms. Melanie Purkey, Executive Director, WVDE Office of Healthy Schools, provided information regarding a number of legislative bills. Discussion ensued regarding legislative bills. (Copy appended to Official Minutes, Attachment U.) XXIII. WVBE Personnel Matters President Linger called for approval of the Board’s personnel matters. Dr. Johnson moved that the WVBE’s personnel matters found in the attachment be approved. Ms. Haden seconded the motion. Upon the call for the question the motion was carried unanimously. Call to Order President Linger called the meeting back to order at 10:32 a.m. XXVI. Board Reports Governor’s Education Efficiency Audit. President Linger (distributed information) provided a brief overview of a document that was prepared to assist the Board in responding to the Governor’s Education Efficiency Audit. Mrs. Manchin addressed the need for a meeting at which the Board would take up the audit report. It was the consensus of the Board that a special meeting be held March 29 and 30 at a location as determined by President Linger. (Copy appended to Official Minutes, Attachment V.) -8WVBE Strategic Planning Committee. Dr. Johnson distributed an update to the Board’s 2011-2012 strategic plan for the Board’s consideration. Ms. Jane Lynch, Executive Director, RESA 8, addressed questions regarding recommendations affecting RESAs. Discussion ensued regarding updates to the strategic plan including recommended actions. President Linger issued concern regarding the wording of the first stated goal. Following discussion, it was the consensus of the Board that the Strategic Planning Committee revisit the strategic goals and bring a recommendation to the Board at a future meeting. (Copy appended to Official Minutes, Attachment W.) WVBE RESA Committee. Dr. Johnson distributed recommendations from the RESA stakeholders in response to the Governor’s Education Efficiency Audit. Dr. Johnson moved that the recommendations from the RESA stakeholders in response to the Governor’s Education Efficiency Audit as found on pages four, five and six of Attachment X, be approved. Ms. Haden seconded the motion. Discussion ensued whereupon Dr. Johnson amended his motion to approve, with flexibility, the recommendations from the RESA stakeholders in response to the Governor’s Education Efficiency Audit as found on pages four, five and six of Attachment X. Ms. Haden attended a NASBE Governmental Affairs Committee meeting, Civics Literacy meeting, and will be participating in a truancy initiative of the Kanawha County Prosecutor’s Office. Mrs. Manchin attended a NASBE Board of Directors meeting, provided a reminder regarding NASBE’s legislative conference to be held March 22-23, 2012, and participated in a Reconnecting McDowell conference call. Mr. Green attended a meeting regarding First Energy. WVBE Student Representative Remarks. Mr. Lockhart (distributed information) addressed the Board regarding his tenure as student representative. The Board recognized Mr. Lockhart for his service as student representative to the Board during the months of December, January and February. Ms. Haden departed the meeting. (Copy appended to Official Minutes, Attachment Y.) XXVII. State Superintendent’s Report Superintendent Marple presented WVDE personnel matters for the Board’s information. (Copy appended to Official Minutes, Attachment Q.) WVDE Work Plan. Mr. Randall Kirk, Assistant Director, WVDE Office of Information Systems, provided a brief overview (via electronic demonstration) of the WVDE work plan. Mr. Green departed the meeting. Advanced Placement Update. Mr. Hull provided an update regarding Advanced Placement. In-Kind Advertising. Heather L. Deskins, general counsel to the WVBE and WVDE, provided information regarding in-kind advertising and advised that in-kind services is allowed but that such service must be for the primary benefit of the school. Substance Abuse Prevention and Interventions Update. Dr. Amelia Courts, Assistant State Superintendent, Division of Educator Quality and System Support, and Ms. Purkey provided information regarding the Governor's Substance Abuse Advisory Council and the variety of activities and initiatives that the WVDE, RESAs and counties are implementing and participating in related to substance abuse prevention -9and intervention. All efforts are being coordinated with the Governor's Substance Abuse Advisory Council's recommendations. (Copy appended to Official Minutes, Attachment R.) XXVIII. Board Items for Future Consideration President Linger asked that items, inclusive of any requested during the meeting be provided to him as soon as possible. Dr. Johnson requested that the strategic plan be placed on the March agenda and that an item be placed on the April agenda regarding the Governor’s Education Efficiency Audit. It was the consensus of the Board that updates regarding BTOP be on each agenda until such time as the project is completed. (Copy appended to Official Minutes, Attachment S.) XXIX. Future Meetings The WVBE will meet, via teleconference, February 22, 2012, in Charleston, West Virginia, to approve critical need and shortage policies. The next regular meeting of the WVBE will be held March 14, 2012, in Charleston, West Virginia. The meeting will continue on March 15, 2012, if the agenda is not completed on March 14, 2012. XXX.
